TERMS AND CONDITIONS OF BUSINESS RCA CONSULTING

offers a professional service for the recruitment of Middle, Senior and Executive Managerial Personnel.

Candidates are introduced to clients and recruitment assignments are accepted on the following conditions:

  1. Consultancy fees are calculated on the appointee's commencement date and are payable within 7 days after the appointee commences employment, in order to validate our guarantee.

    Fees are levied as follows:
    Normal Recruitment 15.0% of annual salary package (plus VAT 14%) *negotiable per assignmen
    Executive Search 25.0% of annual salary package (plus VAT 14%)

    NB: In the case of Executive Search, RCA requires 20% of the fee to be paid on commencement of the assignment, 30% on candidate being interviewed by the client and the balance of 50% on appointment.

    The above fees shall include all normal advertising costs. However, should any specialist or display advertising be commissioned this shall be for the client's account subject to the condition that such expenditure is authorized by the client company.

    The recruitment fee will be calculated on the total forecasted Cost to Company earnings for the first twelve months of employment. No fee is payable should the appointee fail to commence work. A consultancy fee will be levied on any client who appoints a candidate within 1 year of the original candidate introduction.

  2. All candidates appointed through RCA CONSULTING are conditionally guaranteed for a period of 90 days from date of employment. Should the appointee fail to fulfill the job requirements, and for reasonable reasons have his/her employment terminated during the first 90 days, RCA CONSULTING undertake to replace him/her at no further fee. No cash refunds will be entertained. This guarantee specifically excludes redundancy, job misrepresentation and unfair dismissal. In order to validate the guarantee, full payment of the fee must be received within 7 days from the date that employment commences.
  3. Should a candidate, initially introduced by RCA CONSULTING to a client, be appointed and employed in a post other than the job title in the original assignment, the consultancy fee will be payable in full. Furthermore, should a candidate be employed by an associated company or third party in Cape Town, elsewhere in South Africa, or in any other country, then the client originating the assignment will be liable for the full consultancy fee, unless the third party has agreed to pay the fee.
  4. In addition to the normal consultancy fee payable, all direct expenses incurred during an assignment will be for the client's account. No such cost will be incurred on behalf of any client without specific prior arrangement with the client.
  5. Should an assignment be withdrawn prior to, or after completion of the assignment, RCA CONSULTING will be entitled to a minimum fee of R5000.00 to cover recruitment and advertising costs, except if another Recruitment Consultancy should fill the position or should the position be filled as a direct appointment by the client company.
  6. Interest at the maximum rate permissible by law will be charged on overdue accounts.
  7. It is noted that RCA CONSULTING is acting only as an agent for the client company and NOT as principal herein and, although every effort is made to screen and reference check all applicants, RCA CONSULTING accepts no responsibility for any damages suffered by the client company as a result of the introduction and the appointment of the Applicant
